Terms of Service
Effective Date: January 1, 2024 | Last Updated: October 2024
1. Agreement to Terms and Operational Overview
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "Property Owner," or "Authorized Agent") and Mold Remediation Pros ("Company," "we," "us," or "our"), governing your access to and use of our website (https://localmoldremediationpros.com), telephone dispatch services (877-813-4905), and associated structural mold remediation, diagnostic moisture inspection, and environmental drying services.
By scheduling an on-site property assessment, calling our dispatch desk, or executing a work authorization order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must refrain from engaging our services or dispatch personnel.
2. Structural Diagnostic Assessments & Scope of Work
Initial technical evaluations utilize non-invasive moisture meters, thermal infrared cameras, and visual inspections to evaluate potential fungal colonization. Written remediation scopes outline targeted containment zones, estimated equipment runtime (negative air scrubbers, commercial dehumidifiers), and proposed demolition of non-salvageable porous building materials (e.g., colonized drywall, contaminated insulation, damaged subflooring).
Initial diagnostic inspections do not guarantee detection of latent defects or concealed mold growth hidden behind permanent load-bearing masonry, solid cabinetry, under concrete slabs, or within sealed architectural shafts unless invasive exploratory access is authorized in writing.
3. Negative Air Containment & Worksite Safety
Field remediation procedures strictly adhere to environmental industry standards, including ANSI/IICRC S520 guidelines:
- Physical Isolation Barriers: Technicians establish airtight 6-mil polyethylene chambers equipped with zipper access airlocks separating contaminated zones from occupied quarters.
- Continuous Negative Air Pressure: Commercial HEPA air scrubbers operate continuously to exhaust filtered air outdoors and prevent cross-contamination of unaffected rooms.
- Access Restrictions: The Customer agrees that all building occupants, children, and domestic pets must stay completely outside active containment chambers during physical removal, wire brushing, HEPA sanding, and antimicrobial fogging. Entry without certified Personal Protective Equipment (PPE) is strictly prohibited.
4. Customer Obligations: Utilities & Site Access
To ensure safe and effective remediation, the Customer agrees to provide:
- Uninterrupted Utilities: Continuous 120V/15-20A electrical power and running water required to operate high-velocity HEPA scrubbers, desiccant dehumidifiers, and HEPA vacuums. The Customer is responsible for standard municipal utility costs associated with operating remediation machinery.
- Unobstructed Access: Clear physical clearance to affected attics, crawl spaces, basements, utility closets, and electrical circuit breaker panels.
- Legal Authority: The Customer warrants that they are the legal owner of the property or possess full written authorization from the owner or property management firm to authorize structural remediation and material removal.
5. Concealed Damage, Hidden Biohazards & Change Orders
Remediation estimates reflect visible conditions and non-invasive moisture readings. Fungal growth frequently originates behind shower pans, inside insulated wall cavities, and beneath finished flooring. If technicians uncover concealed structural decay, rotted framing timber, unmapped plumbing breaks, or suspected hazardous materials (such as asbestos-containing floor tiles or lead-based paint) during material demolition:
- Work in the affected zone may be temporarily paused to ensure crew and occupant safety.
- A formal written Change of Work Order detailing revised containment requirements, structural bracing, or specialized environmental handling will be presented for Customer approval before proceeding.
6. Independent Air Clearance Testing Protocol
Post-remediation clearance verification provides objective microscopic proof of job completion. To avoid conflicts of interest, we encourage independent third-party environmental testing laboratories or licensed Industrial Hygienists to collect calibrated Spore Trap air cassette samples. A containment zone achieves formal clearance when indoor spore counts and fungal species ecology are statistically comparable to or cleaner than outdoor ambient baseline samples.
7. Source Moisture Resolution & Warranty Exclusions
Mold spores are ubiquitous natural bioaerosols that require persistent moisture, elevated humidity (exceeding 60% RH), and organic substrates to colonize. Remediation eliminates existing fungal colonies and decontaminates air volumes. However, long-term mold prevention requires permanent correction of the underlying moisture intrusion (e.g., repairing roof leaks, fixing pipe breaks, grading foundations, or managing crawl space drainage).
The Company disclaims liability for fungal recolonization occurring after project completion if the Customer fails to repair the underlying moisture defect or maintain indoor relative humidity below 55%.
8. Pricing, Payment Terms & Insurance Coordination
Remediation charges are determined based on labor, specialized equipment run-days, consumable containment barriers, and disposal of regulated microbial waste. Where applicable, we assist property owners with itemized photographic logs and moisture mapping documentation to support property insurance claims. However, the Customer remains primarily responsible for all invoiced amounts regardless of insurance claim determination, deductible limits, or carrier processing delays.
9. Appointment Cancellations & Rescheduling
Non-emergency inspection or remediation appointments may be rescheduled or canceled without penalty by providing at least twenty-four (24) hours advance notice to our dispatch desk (877-813-4905). Emergency dispatch mobilizations involving active containment barrier deployment or emergency structural extraction may incur mobilization and diagnostic service fees if canceled after technicians arrive on site.
10. Limitation of Liability
To the maximum extent permitted by applicable state and federal law, Mold Remediation Pros, its technicians, and affiliates shall not be liable for indirect, incidental, special, or consequential damages resulting from pre-existing fungal damage, structural wood rot, delayed insurance reimbursements, or temporary living disruptions during active containment operations. Total liability for any documented claim shall not exceed the total fees paid by the Customer for the specific remediation service at issue.
11. Governing Law & Dispute Resolution
These Terms and any disputes arising out of property remediation services shall be governed by and construed in accordance with the laws of the State in which the subject property is located, without regard to conflict of law principles. Parties agree to attempt good-faith mediation prior to initiating formal legal proceedings.
